Expungement

In order to have all of your arrest, police and/or court records destroyed and/or taken off the Maryland Case Search, the online public database, a Petition for Expungement must be filed for applicable matters. In regard to Domestic Violence or Protective Orders, the Petition would be to Seal those records.

Because employers and others have access to the public, online Court database, it is important that you Expunge and/or Seal any legal cases or matters that are eligible in order to protect your privacy and reputation. Once a legal matter is Expunged or Sealed, it would be improper for anyone, including the Government, to use that matter against you in any future legal matter.

Most matters where you have been found not guilty or that have been dismissed, entered Nolle Prosequi or Stet should be eligible for Expungement. And the law is ever changing to allow for additional matters to be Expunged including a limited number of misdemeanor criminal convictions as well.

Some cases are immediately eligible for Expungement while other matters may have to wait for up to three (3) years before being eligible. For good cause, however, a request can be made for a Judge to consider allowing a petition to be filed earlier on reasonable grounds such as loss of employment are clearly and sufficiently documented.

Because of limited staff being assigned to these Petitions in the Court, it can take approximately three (3) to six (6) months for the petition to be ruled upon and/or granted. Usually a hearing is not necessary unless the Petition is opposed by the State which can happen for a variety or reasons.
